ARTICLE 1 – PURPOSE AND SCOPE

These Terms and Conditions of Sale define the terms and conditions applicable to distance sales of fragrance creations and perfumery products developed and marketed by the Seller, to any Customer placing an order on the website.

In accordance with Article L.221-5 of the French Consumer Code, the Customer declares that they have read the required pre-contractual information before placing the order.

The Customer acknowledges having read these Terms and Conditions of Sale before ordering and accepts them without reservation by ticking the box provided.

ARTICLE 2 – PRODUCTS, AUTHENTICITY AND BATCH VARIATIONS

The products offered are described as accurately as possible.

2.1 Product authenticity / anti-counterfeiting

The Seller guarantees that the products marketed are authentic, come from lawful supply channels and comply with applicable regulations.

However, the Seller cannot be held responsible for:

  • Minor variations between manufacturing batches;

  • Formulation changes decided by manufacturers;

  • Changes to packaging or presentation made by brands without notice.

The Customer is asked to report any suspected non-compliance or defect immediately.

2.2 Packaging and batch variations

Images displayed on the website are non-contractual. Manufacturers may change:

  • Bottle designs;

  • Boxes;

  • Caps;

  • Information leaflets.

These differences do not affect the product's authenticity or quality.

ARTICLE 3 – PRODUCT AVAILABILITY

Product offers displayed on the website are valid while stocks last.

If a product becomes unavailable after the order has been confirmed, the Seller will inform the Customer as soon as possible and may offer, as appropriate, a full refund, store credit or delayed delivery.

The Seller cannot be held responsible for a temporary or permanent stock shortage.

The Seller does not guarantee that temporarily or permanently unavailable products will be restocked.

ARTICLE 4 – PRICES

Prices are stated in euros (€), inclusive of all taxes, in accordance with Article L.112-1 of the French Consumer Code.

Shipping costs and any import taxes or customs fees are stated before order confirmation, except where exceptions arise from regulations in the destination country.

The Seller reserves the right to change prices at any time; the applicable price is the one displayed when the order is confirmed.

ARTICLE 5 – ORDERING AND CONFIRMATION

Confirmation of the order constitutes an electronic signature within the meaning of Articles 1366 and 1367 of the French Civil Code.

The Seller may refuse or cancel any order, particularly in the event of:

  • Suspected fraud;

  • A payment issue;

  • A previous dispute;

  • Inaccurate information;

  • Misuse of the website.

The Seller also reserves the right to limit the quantities ordered.

ARTICLE 6 – LEGAL CAPACITY

The customer declares that they are of legal age and have full legal capacity to enter into a contract in accordance with Articles 1145 et seq. of the French Civil Code.

Any order placed by a minor must be made under the supervision and with the prior authorisation of a legal representative.

The Seller cannot be held responsible for an inaccurate declaration concerning the customer's age or legal capacity.

ARTICLE 7 – MANIFEST ERROR

Despite the care taken to keep the website up to date, a manifest error concerning the price, description or availability of a product may exceptionally occur.

In the event of an obvious error or an abnormally low price, the Seller reserves the right to cancel the order after informing the Customer and fully refunding any sums paid.

ARTICLE 8 – PAYMENT

Payment is due immediately.

Accepted payment methods are listed on the website. Transactions are secured through an authorised provider.

The Seller may suspend an order while carrying out any anti-fraud checks deemed necessary.

ARTICLE 9 – FRAUD PREVENTION

To prevent fraud and secure transactions, the Seller reserves the right to request any supporting document necessary to approve an order.

In the event of suspected fraud, misuse of a payment method or abnormal behaviour, the Seller may suspend, refuse or cancel the order without notice.

ARTICLE 10 – DELIVERY AND INTERNATIONAL SHIPPING

In accordance with Article L.216-1 of the French Consumer Code, delivery takes place within the period stated when ordering.

10.1 Delays

Delivery times are indicative. The Seller cannot be held responsible for delays caused by:

  • The carrier;

  • Customs services;

  • An event of force majeure;

  • An incorrect address provided by the Customer.

10.2 Customs, taxes and imports

For deliveries outside the applicable tax territory, customs duties, local taxes or import fees may be required by the authorities of the destination country.

These amounts remain entirely payable by the Customer.

The Seller has no obligation to provide exhaustive information on these fees and accepts no liability if the Customer refuses to pay them.

10.3 Transfer of risk

The risk of loss or damage passes to the Customer upon taking physical possession of the products, in accordance with Article L.216-4 of the French Consumer Code.

10.4 Delivery to a Pickup Point – Mondial Relay

When the Customer chooses delivery to a Mondial Relay pickup point or locker, the delivery location selected when ordering may exceptionally change if the location initially chosen is unavailable, closed, full or unable to receive the delivery.

In this case, Mondial Relay may offer the Customer an alternative Point Relais® or locker, or redirect the parcel to another available location nearby, in accordance with its own carriage terms. The carrier will inform the Customer of this change.

Such a change does not, by itself, constitute a failure to deliver, provided that the new collection location remains reasonably accessible to the Customer.

ARTICLE 11 – INSPECTION ON RECEIPT

The Customer must check the condition of the parcel and report any issue within 48 hours, with photographic evidence.

After this period, processing the claim may become more difficult.

ARTICLE 12 – RIGHT OF WITHDRAWAL AND RETURNS

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a statutory period of fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to give reasons for their decision.

The Customer must notify the Seller of their decision to withdraw by any written means that allows proof to be retained.

Products must be returned in their original condition, complete, unused, unopened and in their intact original packaging, allowing them to be offered for sale again.

For reasons of hygiene, safety and protection of cosmetic and fragrance products, any product that has been opened, unsealed, used or tested, or whose packaging has been damaged beyond what is necessary to check its nature and characteristics, may be subject to:

  • Refusal of the return;

  • A reduction in value;

  • Or a partial refund in accordance with Article L.221-23 of the French Consumer Code.

The Customer is responsible for any reduction in the product's value resulting from handling beyond what is necessary to establish its nature, characteristics and proper functioning.

Return costs remain payable by the Customer unless otherwise required by law or an error is attributable to the Seller.

The refund will be made within a maximum of fourteen (14) days from recovery of the returned products or receipt of proof of dispatch provided by the Customer, whichever occurs first.

The refund will be made using the same payment method used for the order, unless expressly agreed otherwise.

The Seller reserves the right to refuse any return that does not comply with these terms.

ARTICLE 13 – STATUTORY WARRANTIES

The Customer benefits from:

  • The statutory warranty of conformity (Articles L.217-3 to L.217-20 of the French Consumer Code);

  • The warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).

ARTICLE 14 – LIABILITY, ALLERGIES AND SENSITIVITIES

The Seller cannot be held responsible for:

  • Improper use;

  • Inappropriate storage;

  • An allergic reaction;

  • Individual sensitivity to an ingredient;

  • Incompatibility with the Customer's skin or preferences;

  • Indirect or non-material damage.

The Customer must check the product's ingredients before use. In the event of a known allergy, a preliminary skin test is recommended.

The Seller does not guarantee that the products will perfectly meet the Customer's subjective preferences or personal expectations.

The Seller's liability is strictly limited to the order amount.

ARTICLE 15 – RETENTION OF TITLE

In accordance with Article 2367 of the French Civil Code, the products remain the Seller's property until payment has been made in full.

ARTICLE 16 – CREATOR AFFILIATE PROGRAMME

The Seller may offer an affiliate programme for creators, influencers and partners.

The terms applicable to the programme are available separately on the website.

ARTICLE 17 – INTELLECTUAL PROPERTY

In accordance with Articles L.111-1 et seq. of the French Intellectual Property Code, all elements of the website are protected.

Any reproduction or use without written authorisation is prohibited.
